Abstract
The construction of New Zealand as a colonial nation was not a conscious act or a single design but the result of cumulative actions (Moon 2006: 22). It started long before and continued well after the signing of the Treaty of Waitangi, and subsequent proclamations of sovereignty. This paper focuses on the period prior to the Treaty of Waitangi when the Supreme Court of New South Wales had jurisdiction over British subjects living in the ‘Islands of New Zealand’.
